1. Accepting these terms
By accessing or using pickism.com (the "Site"), you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the Site. Questions may be directed to [email protected].
2. Changes to these terms
We may modify these Terms at any time. Updates take effect when posted to pickism.com. Your continued use of the Site after a change constitutes acceptance of the revised Terms. You should review this page periodically.
3. Privacy
Our Privacy Policy describes how we handle information collected through the Site. It is incorporated into these Terms by reference.
4. Third-party services
When you access linked third-party services, you may be subject to their terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.
5. Accounts
If and when Pickism offers user accounts, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.
6. Your content and conduct
You retain full ownership of any content you create, submit, or share via Pickism (including your comparison projects, cards, criteria, and reactions). You grant Pickism a limited, worldwide, royalty-free license to host, store, reproduce, and display your content solely as necessary to operate, secure, and improve the service. This license ends when you delete your content, except to the extent others have relied on or shared it, or as required for legal retention.
You agree not to submit content that:
- Is unlawful, defamatory, or infringes on another person's rights
- Contains spam, malware, or malicious code
- Exposes personal information of others without permission
- Harasses, threatens, or targets any individual or group
7. Pickism materials
All Site design, code, brand assets, and content we create (excluding your content) are owned by Pickism and protected by applicable intellectual property laws. You may not copy, redistribute, or create derivative works except as expressly permitted.
8. Hyperlinks and framing
You may link to pickism.com. You may not frame or mirror the Site, or misrepresent its content or origin, without our written consent.
9. Disclaimer of warranties
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, Pickism will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site. Our total cumulative liability will not exceed the amount you have paid us in the preceding twelve (12) months, or one hundred Canadian dollars (CAD 100) if no amount has been paid.
11. Governing law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-laws principles.
12. Jurisdiction
Any dispute arising from these Terms or your use of the Site will be resolved exclusively by the courts of the Province of Quebec, and you consent to their jurisdiction. Class actions and class arbitrations are not permitted.
13. Termination
We may suspend or terminate your access to the Site at any time if you breach these Terms or engage in conduct we determine to be harmful.
14. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pickism regarding the Site and supersede any prior agreements.
15. Feedback
If you send us feedback, ideas, or suggestions, you grant Pickism an irrevocable, worldwide, royalty-free license to use them without obligation to you.
